By downloading, installing, or using the PigeonDispatch mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a binding legal agreement between you and Aaron Seiter ("we," "us," or "our").
You must be at least 13 years of age to use PigeonDispatch. By creating an account, you represent and warrant that you are 13 or older. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the App.
Registration: To use the App, you must register using your mobile phone number. You agree to provide accurate and complete information.
Account Security: You are responsible for maintaining the confidentiality of your verification codes and for all activities that occur under your account. We use Firebase Authentication to secure your sessions, but you must immediately notify us of any unauthorized use of your account.
Account Deletion: You may delete your account at any time via the in-app settings.
PigeonDispatch is a platform for personal communication. You are solely responsible for your conduct and any data, text, or information ("Content") that you submit, post, or transmit via the App.
You strictly agree NOT to use the App to:
Zero Tolerance Policy: We maintain a zero-tolerance policy for objectionable content and abusive users. We reserve the right to suspend or terminate your account immediately, without notice, if you violate these rules.
We do not claim ownership of the messages or Content you transmit through PigeonDispatch. However, by using the App, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and route your Content solely for the purpose of delivering it to your intended recipients and operating the App.
The App, including its original content (excluding User-Generated Content), features, functionality, and design, is and will remain the exclusive property of Aaron Seiter and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
The App may send you push notifications to alert you of new messages or App updates. You may opt-out of these notifications at any time by adjusting the notification settings on your iOS device. However, disabling notifications may impact the core functionality of the messaging experience.
Because you downloaded the App from the Apple App Store, the following terms apply:
Acknowledgment: You acknowledge that these Terms are between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
Maintenance and Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Warranty: We are solely responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. Apple has no other warranty obligation whatsoever.
Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
PigeonDispatch is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's reliability, accuracy, or availability. We do not guarantee that the App will be uninterrupted, error-free, or entirely secure.
To the fullest extent permitted by law, in no event shall Aaron Seiter be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; or (b) any conduct or content of any third party on the App.
You agree to defend, indemnify, and hold harmless Aaron Seiter, its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and verification codes; b) a breach of these Terms; or c) Content posted on the App.
Please read this section carefully. It affects your legal rights.
Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration, rather than in court.
Class Action Waiver: You and Aaron Seiter agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
These Terms shall be governed and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.
